You could have seen this one coming from a mile away–but you were probably texting.
You remember the lady who fell into the fountain at the mall…because she was texting? Ang posted the video on Monday, I believe.
Well, this lady is going to sue. She’s going to sue the mall…I guess. She’s got an attorney, a bruised ego and is going to press charges against someone for making the video public. Gone is any chance that we would never know her name. And if she thought it was humiliating to fall into a fountain, there is no greater public humiliation than filing a frivolous lawsuit against a nameless, unknown entity for something that wasn’t illegal.
While posting the video online was certainly a decision lacking tact, and is probably against mall security policy, I certainly don’t believe it’s illegal. And no one coming to her aid–which is why she’s so upset–isn’t an act of illegality. While it may be unethical, we’re certainly not legally bound to attend to people who may possibly be in need in this country. I think perhaps Ms. Marrero is confused as to why the court system is in place in this country. While it would be great for them to play moral police, it just doesn’t work that way. No doubt she wants an apology. And she should get one. However…
I think she’s going about this the wrong way. She needed a spin doctor, not an attorney. If she would have embraced her plunge into the fountain, she could have come up with a marketing spin on the event, and profited from it handily, or enjoyed 15 minutes of fame, as opposed to 15 minutes of frivolous lawsuit infamy.
I’m no attorney, but here’s my counsel: Drop the suit, Ms. Marrero. It’s just going to make everything worse for you.

This lady needs to get a life. She was in and out of the water in less than 10 seconds. There wasn't even enough time for anyone to even get to her before she was out. I really hope she doesn't get anything out of this bogus lawsuit, except looking like an idiot for not paying attention to where she was going. Sorry lady, but the law can't fix stupid.

Good thing she was not at the grand canyon. I have no pitty for this lady if you are not looking where you are going that is your own fault. If I was texting and walked in front of a car and got hit that is my fault. She walked into a non moving object. I am not saying she is stupid but now I am after she is trying to sue the mall give ma a brake.

She is going to sue the mall, and she works there. Probably got the same law firm as the McDonald's coffee lady. Sad part is the Mall will mostlikely settle because of cost to defend. But like someone said "you can't fix stupid".

What an idiot. She's walking and texting and falls into a fountain, so of course it's someone elses fault. I hope she doesn't have kids, imagine her texting and driving with kids in a car. She's probably related to the idiot woman who burned herslef at McDonalds or the even dimmer one who walked in the middle of the street because google maps didn't tell her to walk on the side of the street with a sidewalk. Ladies, quit trying to make a buck off your own stupidity.
